The information, software, APIs, and services provided by HustlePay (“HustlePay,” “we,” “our,” or “us”) are made available on an “as is” and “as available” basis, without any warranties or guarantees of any kind. By using HustlePay, you acknowledge and agree to the following disclaimers:

1. No Financial Institution

HustlePay is not a bank, money transmitter, payment service provider (PSP), or financial institution. HustlePay does not hold, control, or transfer funds. All settlement of funds, payment authorization, refunds, and chargebacks are handled exclusively between you (the Vendor/Merchant) and your chosen PSP(s).

2. No Liability for Transactions

HustlePay does not guarantee or take responsibility for:

  • The success, failure, or timeliness of any transaction.
  • Fraudulent or unauthorized transactions.
  • Chargebacks, disputes, refunds, or reversals.
  • Errors, delays, or interruptions caused by PSPs, banks, card networks, or third parties.

All transaction-related risks are solely the responsibility of the Vendor and their PSP(s).

3. No Warranties

HustlePay disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or system availability. We do not warrant that the Services will be uninterrupted, error-free, secure, or free from harmful components.

4. Limitation of Liability

To the fullest extent permitted by law, HustlePay shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including loss of profits, business, goodwill, or data) arising out of or relating to your use of the Services, even if advised of the possibility of such damages.

In no event shall HustlePay’s total liability exceed the amount of fees paid by you to HustlePay in the twelve (12) months prior to the claim.

5. Third-Party Services

The Services may enable integration with third-party PSPs, banks, or platforms. HustlePay does not endorse, guarantee, or assume responsibility for the performance, practices, or security of third-party services. Your use of such services is at your own risk.

6. Regulatory Compliance

You are solely responsible for ensuring that your use of HustlePay complies with all applicable laws, regulations, and card network rules, including those relating to payments, AML, sanctions, and consumer protection. HustlePay makes no representation or warranty regarding your compliance obligations.

7. Forward-Looking Statements

Any statements made by HustlePay about potential features, integrations, or functionality are forward-looking and subject to change without notice. We make no guarantee regarding future availability or performance.
